New DOT Rule Could Let Airlines Dodge Hotel And Meal Costs After Maintenance Delays

A new Department of Transportation rule changes how airlines classify certain delays and cancellations, and while most of the carve-outs strike me as perfectly reasonable, one provision concerning unscheduled maintenance could become a very convenient escape hatch for airlines.

The final rule, effective October 19, 2026, creates a new category for 10 events that Congress ordered removed from the traditional “Air Carrier” bucket, which historically covered disruptions deemed within an airline’s control (thus, this is not necessarily a “Trump” issue, as the change was passed overwhelmingly by Congress, signed into law by Biden, but only now being put into effect by the Trump DOT).

Most of the exclusions make sense to me: sabotage, cybersecurity attacks when the airline complied with applicable rules, medical emergencies not caused by the carrier, unruly passengers, volcanic ash, or failures of government systems.
